TERMS AND CONDITIONS

SHAMS is a brand developed by evidence 1.618.

1. THE PRODUCTS

1.1. The description of the products on our site is approximate and the images of the products are given for illustration purposes only. Whilst we endeavor to be as accurate as possible in describing products on our site (including but not limited to size, weight, functions and dimensions) and to accurately reproduce colors , any description remains approximate and we cannot guarantee that the colors displayed on our site accurately represent the true color of the products.

 

1.2. The packaging of the products may also differ from that shown in the illustrations on our site.

 

1.3. All products on our site are presented subject to availability. We inform you by e-mail as soon as possible if the product you ordered is not available. If the product you ordered is not available, we will not process your order.

 

1.4 The products comply with European legislation.

2. ORDERS TERMS OF THE CONTRACT BETWEEN US AND YOU

2.1. Our order process allows you to check and amend any errors before sending us your order. Please take the time to check your order before sending it to us. If you send us an incorrect order, please contact us at contact@shams.com as soon as possible to correct the error. We will endeavor to correct any errors in the order you submit to us before it is processed, however we cannot guarantee that this will always be possible.

 

2.2. The online sales contract is concluded when you confirm the order by clicking on the "SEND ORDER" button (the "order").  By placing an order, you accept these conditions and agree that evidence 1.618 is entitled to collect the full price corresponding to the order.

 

2.3. After placing an order, you will receive a confirmation email from us. Another e-mail informs you of the dispatch of the order (confirmation of dispatch).

 

2.4. If we are unable to supply you with a product (for example, because it is not in stock, it is no longer available or because of an error in the price on our site) , we inform you by e-mail and we do not process your order. If you have already paid for the product, we will refund the full amount to you as soon as possible and, in any case, within 14 days of the notification we send you by e-mail.

 

2.5. SHAMS reserves the right to refuse, suspend or cancel the processing of an order and/or the delivery of products regardless of their nature or stage of processing in the event of non-payment of all or part of the sums due under of the order concerned or any previous order, payment incident, fraud or attempted fraud related to the use of the SHAMS site in the context of the order concerned or any other previous order, violation of these conditions and /or any additional conditions which are presented to you on our site at the time of the purchase of a product or where the applicable law or regulation authorizes and/or imposes it.
In these cases, you agree that SHAMS may use the personal data provided by you in connection with the order in order to carry out the necessary checks, including appropriate anti-fraud investigations. Automated processing may be implemented in this context, such as for example to analyze the quantities ordered and refuse, suspend or cancel an order if it does not comply with these conditions and/or any additional conditions presented to you on our site at time of purchasing a product. In case of refusal, suspension or cancellation of your order, you can then contact us for any question concerning this decision.
In these cases, the data relating to your order may also be transmitted to any third party authorized by law or designated by SHAMS for the sole purpose of verifying your identity and validating the order, the method of payment used and the type of delivery. After carrying out the above checks, SHAMS reserves the right to request a photocopy of your identity document. You have the right to access, modify and delete any personal data processed by SHAMS in accordance with the conditions set out in the privacy policy.

3.Livraison

3.1  SHAMS ships to the following countries/regions:

France, Germany, Spain, Netherlands, Belgium, Luxembourg, Spain, Italy, Portugal, Finland.

3.2. Shipping and handling costs are automatically calculated based on the delivery address and are included in the total price of your order. As a general rule, we send all items using a reliable carrier. Depending on the country of delivery, please allow 3-14 calendar days for delivery once dispatch confirmation is received.

 

3.3. Please refer to the delivery confirmation email from our carrier for accurate information and package tracking reference. A verification of identity document may be carried out upon delivery.

 

 

3.4 You are invited to check the visual condition of the package and the product at the time of delivery.  In the event of a problem (missing or damaged product), you must follow the applicable procedure below to refusal of delivery.

 

If the package is damaged on delivery, you can inform the carrier of the problem and refuse delivery.  The carrier then keeps the package. You are then contacted by SHAMS customer service as soon as possible to examine the refusal. If the transport-related problem is confirmed by SHAMS customer service, the order is canceled and you are reimbursed.

4. PRICE OF PRODUCTS AND DELIVERY COSTS

4.1. The prices of the products are those indicated on our site at any time. Please refer to Section 4.3 for information regarding pricing errors on our site.

 

4.2. The prices of our products are subject to change at any time. Any change in the price of the products on our site does not modify the order of the product(s) that we have confirmed to you by means of a dispatch confirmation.

 

4.3 Our site contains a large number of products. It is possible that, despite our best efforts, some of the products on our site are incorrectly priced. If the pricing error is obvious and obvious and you could reasonably have recognized it as such, we are not obliged to supply you with the products at the incorrect (lower) price. You agree to pay the full price of any purchases made, either when ordering online or by any other means of payment acceptable to us. Payment for products is made in advance.

 

 

5.3. Certain products you purchase from our site may be subject to additional terms and conditions presented to you at the time of purchase.

6. RETURN

6.1. We want your order to bring you complete satisfaction. Subject to certain exceptions described below, if you are not satisfied for any reason, we gladly accept return of the product within 14 days of receipt. To return an item to us, please follow our returns procedure outlined below.

 

6.2. All products must be returned to us with the original receipt, in unused and new condition, with all of the original shipping and product packaging, protective materials and labels in the appropriate places.

 

6.3. We refuse any return if the product shows signs of handling other than those necessary to establish the nature, characteristics and operation of the product, or if it has been used or modified in any way from its initial state. , or if the period mentioned above and in paragraph 6.1 is exceeded.

 

6.4. The return is made from the country where the product was delivered.

 

6.5. To return a product to us, please follow our return procedure below:

7. OUR RESPONSIBILITY TOWARDS YOU AS A CONSUMER

7.1 As a consumer, you benefit from the mandatory provisions of the law of the country in which you reside. Nothing in these Terms, including the choice of law clause below, affects your right as a consumer to rely on these mandatory provisions of local law.

 

7.2 In addition to these legal guarantees, please note that the product you have purchased is also covered by a commercial guarantee, the conditions of which are set out in the guarantee document and/or the page to which the link leads included in the original packaging of the product. . 

 

7.3 If SHAMS breaches these Terms, we are liable to you for any loss or damage you suffer that is the foreseeable result of our breach of these Terms.

 

 

7.4 We only supply the products for domestic and private use. You agree not to use the product for commercial, business or resale purposes. Further, we shall not be liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
